ECA Service Terms

  1. Terms and Conditions
    Upon registration as a user for Empty Collection Appointment Service ("ECA Service") you agree to be bound by the following terms and conditions:
    1. Membership Terms;
    2. The Site Terms;
    3. The ECA Operating Rules; and
    4. These ECA Service Terms:
      Copies of Membership Terms, the Site Terms the ECA Operating Rules and these ECA Service terms are all available on website of OnePort Limited.
  2. ECA Service Transaction Fees
    1. An ECA Service Transaction Fee is payable per confirmed appointment per empty container.
    2. The amount of the ECA Service Transaction Fee is set in the ECA Operating Rules.
    3. If you use ECA Service to make an appointment you are responsible for payment of ECA Service fees regardless of whether you sub-contract the pick up of the container to another person.
    4. No refund of ECA Service fees will be given if a confirmed ECA Service appointment is cancelled.
  3. Pick Up Locations
    ECA Service is provided at the locations set out in the ECA Operating Rules.
  4. Appointments, Amendments, Cancellation, Pick Up
    The rules governing making, amending and cancelling ECA Service appointments and picking up containers are set out in the ECA Operating Rules.
  5. Other Requirements for Release
    1. Confirmation of an ECA Service appointment is not a guarantee of release of a container.
    2. Container release remains subject to the relevant shipping line's and relevant Terminal's instructions and presentation by you of any documents required by the relevant shipping line and/or the relevant Terminal.
  6. Detention
    1. You are responsible to the relevant shipping line for any detention charges that may be payable as a consequence of your using the ECA Service.
    2. The shipping lines' detention period may commence once an ECA Service appointment has been confirmed (a 'virtual gate out') and continue it until the time the relevant Terminal confirms a cancellation request to either OnePort Limited or the relevant Shipping Line.
  7. Inspection
    OnePort Limited makes no warranty that containers subject to ECA appointments will be free of damage and in good condition.
  8. Conflicts
    In the event of any conflict between the ECA Operating Rules and these ECA Service Terms, the provisions of these ECA Service Terms shall take precedence.
  9. Definitions
    "ECA Service" means the Empty Collection Appointment Service.
    "Terminal " includes each of those container Terminals in Hong Kong named in the ECA Operating Rules.
    "You" means the user of the ECA Service.

Remarks: OnePort Limited may make changes to the above ECA Service Terms whenever it deems necessary, without notice.
